Christmas Giveaway – Christmas Mugs

Platform Notice (Instagram):
This giveaway is in no way connected with Instagram and is in no way sponsored, supported, or organised by Instagram. The recipient of the information provided by participants is solely Porzellanmanufaktur FÜRSTENBERG GmbH. All questions, comments, and/or complaints regarding the giveaway should be directed exclusively to Porzellanmanufaktur FÜRSTENBERG GmbH.

1. Organiser

Porzellanmanufaktur FÜRSTENBERG GmbH, Meinbrexener Straße 2, 37699 Fürstenberg, Germany.

2. Eligibility to Participate

Only natural persons aged 18 or over are eligible to participate. Employees of Porzellanmanufaktur FÜRSTENBERG GmbH and affiliated companies are excluded from participation. Participation is free of charge and independent of the purchase of goods or services.

3. Competition Period

The giveaway takes place from 28 October 2025, 3:00 p.m. until 3 November 2025, 11:59 p.m. Entries submitted outside this period will not be considered.

4. Conditions and Procedure of Participation

Participation takes place via the official Instagram channel of Porzellanmanufaktur FÜRSTENBERG. Requirements:
1) Like the giveaway post,
2) Follow the @fuerstenbergporzellan account,
3) Tag one person in the comments and answer: “Who would you place our Christmas mug under the tree for — and why?”

Multiple comments do not increase the chance of winning. Comments/tags must not infringe third-party rights (including copyright, trademark, name, or personal rights) and must not violate legal provisions or accepted standards of decency (e.g. no offensive, discriminatory, extremist, glorifying violence, sexist, pornographic, or advertising content). Such entries will be deleted, and the participants excluded. By taking part, participants accept these Terms and Conditions of Participation.

5. Prizes, Selection, and Notification

Prizes (2 in total):
– 2× mug sets, each consisting of “THE BOW” (Art. No. OB6412960532) and “FESTIVE PENGUIN” (Art. No. OB6412960531) (1 set per winner).

Selection & Notification:
The two winners will be selected at random within 3 working days after the end of the participation period from all valid entries. Notification will be sent via direct message (DM) on the respective platform within 7 days after the draw. Winners must respond within 7 days of the notification being sent and provide the data required for shipping. If no timely response is received, the prize will be forfeited and a replacement winner will be drawn. Winners will not be announced publicly. There is no cash alternative, exchange, or transfer of prizes. Product or design variations due to production processes may occur.

6. Shipping and Data Information

To process the prize, winners must provide their name and postal address (and, if necessary, email/telephone number for queries). Shipping will be carried out exclusively by Porzellanmanufaktur FÜRSTENBERG GmbH. If desired, the prize can be sent to two delivery addresses (normally one mug per address); this must be explicitly stated when providing the data. Shipping within the EU only; any taxes or customs duties outside Germany are the responsibility of the recipient. Winners are responsible for the accuracy of the information provided.

7. Exclusion of Participants

The organiser reserves the right to exclude participants from the giveaway at any time and without notice in the event of violations of these Terms and Conditions, attempts at manipulation, use of fake/bot/giveaway accounts, or automatically generated mass participation. Prizes may be subsequently revoked and reclaimed.

8. Interruption or Termination of the Giveaway

The organiser reserves the right to modify, suspend, or terminate the giveaway for important reasons if proper execution can no longer be guaranteed for technical, legal, or organisational reasons (e.g. platform or network outages, manipulation).

9. Liability

Porzellanmanufaktur FÜRSTENBERG GmbH is liable for damages only in cases of intent or gross negligence. Claims for damages arising from injury to life, body, or health as well as in cases of breach of essential contractual obligations (cardinal obligations) remain unaffected. In the case of slight negligence in the breach of essential contractual obligations, liability is limited to the foreseeable, typically occurring damage.

10. Severability Clause

Should individual provisions of these Terms and Conditions be or become invalid in whole or in part, the validity of the remaining provisions shall not be affected. A valid provision that most closely reflects the economic purpose of the invalid one shall apply instead.

11. Final Provisions

German law applies. Legal recourse is excluded.

Privacy Notice pursuant to Art. 13 GDPR

1. Scope and Purpose of Processing Personal Data

The following provisions apply when you participate in our giveaway. For shipping the prize, the name and address of participants will be processed. Porzellanmanufaktur FÜRSTENBERG GmbH stores the personal data of participants solely for the purpose of conducting the giveaway. Participants expressly agree that the personal data provided in connection with this giveaway may be collected, processed, and used by Porzellanmanufaktur FÜRSTENBERG GmbH for the purpose of executing the giveaway and possible prize processing, in compliance with data protection regulations. If the purpose for storing your data no longer applies, it will be deleted without delay. In the event of a win, personal data (email address, name, and address) may be shared with cooperation partners if required to provide the prize.

2. Legal Basis

The processing of your data is based on Art. 6 (1) lit. b GDPR. The collection and further processing of your data is necessary to carry out the giveaway in accordance with these Terms and Conditions.

5. Your Rights

Withdrawal of Your Consent to Data Processing:

You may withdraw your consent to data storage at any time by submitting a written notice to scope & focus Service-Gesellschaft mbH. In this case, the participant will be excluded from the prize allocation.

Right to Lodge a Complaint with the Competent Supervisory Authority:

In the event of a breach of the GDPR, data subjects have the right to lodge a complaint with a supervisory authority, in particular in the Member State of their habitual residence, place of work, or the place of the alleged infringement. This right to lodge a complaint exists without prejudice to other administrative or judicial remedies.

Right to Data Portability:

You have the right to receive data that we process based on your consent or in fulfilment of a contract in a commonly used, machine-readable format, or to have it transferred to another controller, where technically feasible.

Right to Access, Erasure, and Rectification:

You have the right, within the framework of the applicable legal provisions, to obtain free information at any time about your stored personal data, its origin and recipients, and the purpose of data processing, and, where applicable, a right to rectification or erasure of this data. For this purpose, and for any other questions regarding personal data, you may contact us at any time.

Right to Restriction of Processing:

You have the right to request restriction of the processing of your personal data. This right applies in the following cases:

If you dispute the accuracy of your personal data stored by us, we usually need time to verify this. During the verification period, you have the right to request restriction of the processing of your personal data.

If the processing of your personal data was or is unlawful, you may request restriction of data processing instead of deletion.

If we no longer need your personal data but you require it to exercise, defend, or assert legal claims, you have the right to request restriction of processing instead of deletion.
